Privacy policy

  1. This Privacy Policy lays down the rules for the collecting, processing, and using of personal data obtained from a User of the alvetro.it website (hereinafter referred to as the “Website”) by Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o., ul. Ceramiczna 6, 21-025 Niemce, entered into the Register of Entrepreneurs by the District Court for the City of Lublin, VIth Commercial Division of the National Court Register, National Court Register Number (KRS): 0000055933, Tax Identification Number (NIP): 712-015-63-17, National Business Register Number (REGON): 008020930, share capital: PLN 250 000.00 – fully paid up, hereinafter referred to as the Controller.
  2. The Controller protects the User’s data pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (the “GDPR”), as well as the Personal Data Protection Act of 10 May 2018.
  3. The Controller exercises due diligence in order to protect the interests of data subjects, and, in particular, the Controller ensures that the data collected by it are processed in accordance with the law: collected for specified, lawful purposes and not subjected to further processing that would be at variance with those purposes; factually correct and adequate for the purposes for which they are processed, as well as stored in a form enabling identification of data subjects no longer than what is necessary to achieve the purpose of the processing.

Types of data processed

  1. The Controller will process the User’s data provided by the User in the contact form, the data concerning the User’s activity on the Website, and the data concerning the User’s session, device, operating system, browser, location, and unique ID.
  2. Personal data of Users are collected in the case of:
  • use of the contact form service, in order for the electronically provided service to be performed. Legal basis: necessary for the performance of the contract for the provision of the contact form service (Article 6(1)(b) of the GDPR).
  • marketing (Article 6(1)(a) of the GDPR – consent).
  • direct marketing (Article 6(1)(f) of the GDPR – legitimate interests pursued by the Controller).
  1. When the contact form service is used, the User provides his/her name, surname, e-mail address, and telephone number.
  2. When using the Website, additional information may be collected, in particular: the IP address assigned to the User’s computer or the external IP address of the Internet service provider, domain name, browser type, access time, operating system type.
  3. Navigation data, including information about links and references, which Users decide to click, or about other actions taken on the Website, may be collected from Users too. Legal basis: legitimate interests (Article 6(1)(f) of the GDPR) that consist in facilitating the use of electronic services as well as in improving the functionality of these services.
  4. Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. processes personal data including: name, surname, e-mail address, as well as any answers to the questions prepared as part of the satisfaction survey and forms used to assess satisfaction. Participation in such campaigns is voluntary. If the User does not agree to participate in such campaigns, he/she may inform Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. at any time at the address indicated below, and the Controller will consequently block the relevant data. Legal basis: legitimate interests (Article 6(1)(f) of the GDPR) that consist in improving the functionality of electronically provided services, as well as in the assessing of satisfaction with the services that we provide.
  5. The submission of personal data to Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. is voluntary, in connection with the provision of services through the Website, with the proviso that failure to provide the data specified in the forms will prevent the User from submitting an inquiry and obtaining an answer.
  6. Submission of some data is the necessary condition for using particular services and functions of the Website (obligatory data). The consequence of not providing such data is our inability to provide specific services and functions. The provision of personal data other than the data designated as obligatory is voluntary. Legal basis: necessary for the performance of the contract for the provision of services (Article 6(1)(b) of the GDPR).

Access to and storage of User data

  1. The Controller does not sell Users’ data or exchange them for marketing purposes with third parties. Any data transferred to external entities are used only for the provision of services by the entities entrusted with the processing of the data. Transfer of data by the Controller does not happen in every case, and not to all recipients or categories of recipients indicated in the privacy policy – the Controller transfers data only when this is necessary to achieve a given purpose of personal data processing and only to the extent necessary to achieve same.

The personal data of the Website’s Users may be transferred to the following recipients or categories of recipients:

  1. The parent company – Przedsiębiorstwo Produkcji Materiałów Budowlanych Niemce Spółka Akcyjna, Ulica Bagno 2 C Lokal 241, 00-112 Warsaw – the Controller makes available the collected personal data in order to identify the User who submits the content included in the contact form on the Website, and to handle his/her inquiry sent through the provided form, that is, among other things, in order to respond to the request, prepare and send a commercial offer in response to the request sent using the contact form.
  2. Service providers that supply the Controller with technical, IT, and organizational solutions enabling the Controller to conduct business activity, including the Website and electronic services provided through the Website (in particular, computer software providers, e-mail and hosting providers, and providers of software for managing the company and rendering technical assistance for the Controller) – the Controller makes available the collected personal data of the User to the selected provider that acts at the Controller’s request only in the case and to the extent necessary to achieve a given purpose of data processing that is consistent with this privacy policy.
  3. Providers of accounting, legal, advisory, and marketing services who supply the Controller with accounting, legal, advisory, or marketing support (in particular an accounting office, law firm, debt collection company, advertising agency) – the Controller makes available the collected personal data of the User to the selected provider that acts at the Controller’s request only in the case and to the extent necessary to achieve a given purpose of data processing that is consistent with this privacy policy.
  4. Personal data of the User are transferred to service providers used by Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. Service providers to whom personal data are transferred – depending on contractual arrangements and circumstances – are either subject to instructions from Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. regarding the purposes and methods of processing such data (processors) or independently determine the purposes and methods of their processing (controllers).
  • Processors: Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. uses suppliers who process personal data only at the request of Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. These include, among others, the providers who perform the hosting service, accounting services, marketing services, who supply systems for marketing, systems for analysing traffic on the Website, systems for analysing the effectiveness of marketing campaigns.
  • Controllers: Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. uses suppliers who do not act only on request, and who independently determine the purposes and methods for using the personal data of Users.
  1. The service providers are located mainly in Poland and other countries of the European Economic Area (EEA).
  2. The User’s personal data are stored:
  • If the basis for the processing of personal data is consent, then the User’s personal data are processed by Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. until the consent is revoked, and, after the consent has been revoked, for a period of time corresponding to the period of limitation of the claims which Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. may make, and which may be made against it. Unless a special law provides otherwise, the period of limitation is ten years, and for claims for periodic benefits or claims related to the conduct of business activity – three years.
  • If the basis for data processing is legitimate interests pursued by the Controller, then the period of storage of personal data depends on the circumstances that suggest the existence of interests on the side of the Controller.
  • If the basis for data processing is related to an obligation that burdens the Controller according to the law, then the period of storage of personal data results from specific provisions of law which impose on the Controller the obligation to store data.
  1. Navigation data may be used to provide the User with better service, to analyse statistical data, to adapt the Website to the User’s preferences, and to administer the Website.
  2. If requested to do so, Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. provides personal data to authorized state institutions.

Purpose of data processing

  1. Personal data concerning Users who use the Website are processed in order to identify the User who submits the content of the contact form on the Website, to handle the inquiry sent through the provided form, to respond to the request, to prepare and send commercial offers, to ensure full administrative support for the Website, and for the purposes of hosting.
  2. Data may be processed for marketing purposes: including profiling and for analytical purposes, as well as for the use of cookies that are necessary for the proper functioning and displaying of the website.
  3. The purpose, basis, period, scope, and recipients of personal data processed by the Controller depend – every time – on the actions taken by the given User on the Website.

Change in the purpose of data processing

The Controller will immediately inform about any change in the purpose for which the Controller uses personal data or changes in the User’s rights by e-mail or in writing.

Rights of the User

Right of access to data 

The User has the right at any time to request information about what personal data of the User are stored by Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. Right to data portability

Where the Controller processes the personal data of the User in an automated manner, based on consent or a concluded contract, the User has the right to receive a copy of his/her data in a structured, commonly used, and readable format. This copy may be sent directly to the User or to another entity. This applies only to personal data that have been submitted to Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o.

 

Right to rectification

The User has the right to request that his/her personal data be corrected if they are incorrect, as well as that incomplete data be completed. Right to erasure

The User has the right to demand at any time that the data processed by the Controller be erased, when: these data are no longer necessary for the purposes for which they were collected by the Controller; the User withdraws his/her consent to the processing of the data; the User objects to the processing of the data; the User’s data are processed illegally; the data should be deleted in order to comply with an obligation arising from the law.

Right to refuse consent to the processing of data on the basis of the Controller’s legitimate interests

The User has the right to refuse consent to the processing of his/her data on the basis of legitimate interests of Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. In such a case, the Controller will cease to process the User’s personal data, unless the Controller is able to find a lawful justification for this process that invalidates the User’s interests or rights. In this case, direct marketing of Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. cannot be a lawfully justified purpose.

Right to refuse consent to direct marketing

The User has the right to refuse to receive marketing materials directly. He/she may opt out of receiving direct marketing materials as follows:

  • by following the instructions contained in any such e-mail message,

Right to restriction

The User has the right to demand that the Controller restrict the processing of his/her personal data.

Right to lodge a complaint with the supervisory authority

If the User believes that the Controller is processing his/her personal data in an improper manner, in an unlawful manner, or insufficiently protecting these data, then he/she may contact us. He/she also has the right to lodge a complaint with the supervisory authority, which, as of 25 May 2018, is the President of the Personal Data Protection Office.

The User has the right at any time to withdraw his/her consent to the processing of personal data and the receiving of direct marketing materials.

In the case of withdrawal of the consent, Przedsiębiorstwo Budowlane KONSBUD Sp. z o.o. will no longer send the User any offers constituting direct marketing or information previously sent on the basis of the consent to the processing of data.

COOKIE POLICY

  1. The Controller automatically collects data contained in cookies while the website is being used.
  2. ‘Cookies’ are IT data, in particular text files, which are stored on the end-user device of the Website’s User, and which are intended to enable the use of the Website. Cookies usually contain the name of the web page from which they originate, the time of storing them on the end-user device, and a unique number.
  3. Cookies are used for the following purposes:
  • adapting the contents of the Website to the User’s preferences, and optimizing the use of web pages – in particular, these files allow to recognize the Website User’s device and properly display a web page, adjusted to his/her individual needs;
